By accessing, utilizing, or interacting with any aspect of KOTH By Nelzi's services, infrastructure, digital assets, software applications, or related content (hereinafter collectively referred to as "the Services"), you hereby irrevocably acknowledge, warrant, and covenant that you have thoroughly examined, comprehended, and unconditionally accede to be legally bound by these Terms of Service and End User License Agreement (EULA) in their entirety. KOTH By Nelzi grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use our Services solely for personal or internal business purposes, contingent upon strict adherence to all terms herein. Your continued use of the Services shall constitute ongoing acceptance of any modifications to these terms, which may be implemented at our sole discretion without prior notification.

Users hereby acknowledge and warrant compliance with the following non-exhaustive stipulations: • Possess legal capacity and have attained a minimum age of 13 years in their jurisdiction of residence • Assume full responsibility for the veracity, accuracy, and completeness of all provided information • Abstain from reverse engineering, decompiling, disassembling, or attempting to derive source code • Refrain from renting, leasing, lending, selling, redistributing, or sublicensing any aspect of the Services • Warrant against creating derivative works or removing/altering proprietary notices • Accept prohibition of automated access methods including bots, scrapers, or spiders • Acknowledge mandatory attribution requirements during streaming ("KOTH By Nelzi - https://koth.nelzi.me" visible on gameplay) • Accept that failure to display required attribution may result in immediate license revocation • Acknowledge that any violation may result in immediate termination without compensation

The Services implement comprehensive data collection and processing protocols in accordance with GDPR, CCPA, and other applicable regulations. Users are granted specific rights regarding their personal data, including access, rectification, erasure, and portability, subject to legal limitations. While we implement industry-standard security measures, we expressly disclaim any guarantees regarding absolute security. We maintain sole discretion over data processing activities and reserve the right to modify practices without prior notification. All content, materials, code, algorithms, methodologies, interfaces, graphics, logos, designs, compilation features, source code, object code, and software (collectively, "Protected Materials") constitute the exclusive intellectual property of KOTH By Nelzi and/or its licensors, protected under international intellectual property laws. No rights or licenses are granted except as explicitly stated herein. Users are expressly prohibited from any unauthorized use, modification, or distribution of Protected Materials. Violations may result in immediate termination and legal action.

• All payments are categorically non-refundable under any circumstances • No credits issued for partial-month subscriptions or unused Services • No direct upgrade paths between license tiers - new purchase required • We retain unilateral authority to modify pricing structures without notice • Users bear absolute responsibility for all charges • Serial keys are non-transferable and may be revoked at our discretion • We assume no liability for service interruptions or consequential damages • Termination requests must be submitted 30 days prior to renewal

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOTH BY NELZI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE. IN NO EVENT SHALL KOTH BY NELZI BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR USE. TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF AMOUNTS PAID OR $100.00. We maintain absolute discretion to suspend or terminate services without prior notice or liability.
